Democrat Zach Adamson, council vice president and vocal opponent to Stephen Clay, says he's confident the vote will still happen on Monday.

The lawsuit states that Clay violated state law when he terminated staff members without the authority of the full council.

Last week Clay fired the council clerk and the clerk's assistant. The following day, he says, city documents were found destroyed in a paper shredder.

Some members of the council also question whether Stephen Clay has the authority to fire these staff members.

This means that while Miller can still attend full council meetings, he cannot participate in special meetings GOP members use to discuss strategy.

A judge ordered Miller to avoid all contact with specific people who might be witnesses in his case.

Republican Minority Leader Michael McQuillen initiated the vote Monday in a special meeting.
