A man is suing the city after he was kicked in the face by an Indianapolis police sergeant on Monument Circle in 2021.

Sgt. Eric Huxley faces federal and local criminal charges for the incident. A federal grand jury indicted him on a charge of deprivation of rights last October. He is also charged with felony official misconduct and felony battery resulting in moderate bodily injury in Marion County.

Body-worn camera footage from the incident shows Huxley kick a man, identified as Jermaine Vaughn, in the face while he is being placed under arrest and in handcuffs. Huxley can be heard repeatedly saying, “You’re done” to Vaughn after kicking him. The incident took place after officers responded to complaints of Vaughn acting disorderly.

The lawsuit, filed by Vaughn, asks for monetary damages and requests a jury trial.

The Indianapolis Metropolitan Police Department declined to comment on the lawsuit.
